Abstract: | La presente investigación se basa en el principio non bis in ídem, por el cual no se puede sancionar dos veces a un sujeto por el mismo hecho, siempre que cumpla la triple identidad siendo la de sujeto, hecho y fundamento. Es así que, actualmente en los casos de contaminación por vertidos no autorizados de efluentes industriales, la autoridad administrativa está optando por sancionar sólo en el ámbito administrativo dejando de lado al ámbito penal. Por lo que, es necesario determinar bajo qué supuestos se inaplicaría el principio non bis in ídem, a fin de poder castigar las conductas correspondientes bajo una multa y una pena. Con lo cual ante la acumulación de sanciones provenientes de diferentes órdenes obedezcan a diferente fundamento, que los bienes jurídicos sean distintos, es decir, que el interés jurídicamente protegido por la infracción administrativa sea distinto al de la acción penal, así se sancionará como corresponde tanto en el ámbito administrativo como penal. The present investigation is based on the non bis in idem principle, by which a subject cannot be punished twice for the same fact, as long as it fulfills the triple identity of subject, fact and foundation. Thus, currently in cases of contamination due to unauthorized discharges of industrial effluents, the administrative authority is choosing to sanction only in the administrative sphere, leaving aside the criminal sphere. Therefore, it is necessary to determine under what circumstances the non bis in idem principle would not be applied, in order to be able to punish the corresponding conduct with a fine and a penalty. Therefore, given the accumulation of sanctions from different orders that obey a different basis, that the legal rights are different, that is, that the interest legally protected by the administrative infraction is different from that of the criminal action, thus both will be sanctioned accordingly in the administrative and criminal spheres. |
