Abstract: | Los ciudadanos, en mérito del principio de autonomía de la voluntad, tienen el derecho de autorregular sus relaciones, así como celebrar los actos jurídicos necesarios para satisfacer sus intereses dentro de lo establecido en el sistema legal. En materia Tributaria, dicho principio puede ser expresado a través de la planificación fiscal, mediante la cual los contribuyentes eligen el mecanismo legal para estructurar y desarrollar la actividad económica seleccionar la estrategia tributaria que más beneficios les otorgue, a efectos de obtener ventaja tributaria y ahorro fiscal. Al respecto, el Estado ha previsto en el Código
Tributario la Norma XVI, denominada norma antielusiva general que intenta regular las prácticas elusivas y de fraude tributario. En ese sentido, la presente investigación busca determinar si la norma antielusiva general vulnera el principio de autonomía de la voluntad en el marco de la planificación fiscal. Se concluyó que el principio de la autonomía de la voluntad no es vulnerado por la norma anti elusiva general, toda vez que la Norma XVI sólo constituye un límite de regulación establecido en la Ley que intenta corregir las prácticas tributarias fraudulentas realizadas en la realidad económica. In Tax matters, this principle can be expressed through tax planning, through which taxpayers choose the legal mechanism to structure and develop economic activity, select the tax strategy that grants them the most benefits, in order to obtain tax advantage and savings. fiscal. In this regard, the State has provided for Rule XVI in the Tax Code, called the general anti-avoidance rule that attempts to regulate tax avoidance and fraud practices. In this sense, this investigation seeks to determine whether the general anti avoidance rule violates the principle of autonomy of will in the framework of tax planning. It was concluded that the principle of autonomy of will is not violated by the general anti avoidance rule, since Rule XVI only constitutes a regulation limit established in the Law that attempts to correct fraudulent tax practices carried out in economic reality. |
